Welcome to Defender Bikes. These Terms of Service govern your use of defenderbikes.com, your purchase of products from Defender Bikes, and related services provided by Defender Bikes.

By accessing our website, placing an order, or purchasing a product from Defender Bikes, you agree to these Terms of Service and the policies referenced within them.

1. About Defender Bikes

Defender Bikes designs and builds premium bicycles, including mountain and gravel bikes, along with related products and accessories.

Many Defender bicycles are built or configured specifically for individual customers. Product specifications, component selections, colors, availability, and build options may therefore vary.

2. Eligibility and Website Use

You may use our website only for lawful purposes.

You agree not to:

  • Use the website for fraudulent or unlawful activity;
  • Attempt to interfere with the operation or security of the website;
  • Attempt to gain unauthorized access to the website, accounts, systems, or customer information;
  • Use automated systems to scrape, copy, or extract website content without authorization; or
  • Use Defender Bikes’ intellectual property without permission.

We may restrict or terminate access to the website when reasonably necessary to protect Defender Bikes, our customers, or our systems.

3. Product Information

We make reasonable efforts to accurately describe our bicycles, components, specifications, colors, dimensions, pricing, and other product information.

Because bicycles may be individually configured and components may change over time, photographs and other website content may show configurations that differ from the exact product ultimately supplied.

Minor differences in color, finish, appearance, component revisions, or manufacturing details may occur.

If a specified component becomes unavailable before a bicycle is completed, Defender Bikes will contact the customer when a materially different substitution is necessary.

4. Custom and Built-to-Order Bicycles

Many Defender bicycles are built or configured specifically for the customer.

Customers are responsible for reviewing and confirming important order information, including bicycle model, size, configuration, component selections, color selections, shipping information, and other specifications before the order is finalized.

Once production, painting, component procurement, or assembly has begun, changes to an order may not be possible or may result in additional costs or delays.

5. Orders

Submitting an order does not necessarily mean that Defender Bikes has accepted the order.

We reserve the right to decline or cancel an order before fulfillment when reasonably necessary, including because of:

  • Product or component unavailability;
  • Incorrect pricing or product information;
  • Suspected fraud or unauthorized payment activity;
  • Shipping restrictions;
  • Technical errors; or
  • Circumstances that make fulfillment impracticable.

If Defender Bikes cancels an order after receiving payment and the cancellation is not caused by a customer payment dispute or similar issue, amounts paid for the cancelled portion of the order will be refunded as appropriate.

6. Pricing and Payment

Prices are displayed in the currency identified during the purchasing process.

Applicable taxes, shipping charges, customs charges, or other fees may be added where appropriate.

Defender Bikes may change pricing at any time. Price changes do not retroactively change the agreed price of an order that has already been accepted unless the customer and Defender Bikes agree to modify that order.

You agree to provide accurate and authorized payment information when making a purchase.

7. Deposits and Custom Orders

If Defender Bikes requires a deposit for a custom or built-to-order bicycle, the applicable deposit amount and payment schedule will be communicated during the ordering process.

Because custom orders may require Defender Bikes to purchase components, reserve production capacity, begin painting, or perform other work specifically for the customer, deposits or payments may become non-refundable once such work has begun, to the extent permitted by applicable law.

Any order-specific deposit or payment terms communicated to and accepted by the customer will form part of the purchase agreement.

8. Returns

Because Defender bicycles are built to order and may be configured specifically for an individual customer, completed bicycles are generally not eligible for ordinary returns or exchanges.

Defects, manufacturing issues, incorrect components, and workmanship concerns are handled under our Warranty & Liability Policy.

9. Five-Year Frame Warranty, Two-Year Wheel Warranty

Defender-branded bicycle frames are covered by a five (5) year limited warranty, and Defender-branded wheels are covered by a two (2) year limited warranty, to the original purchaser against defects in materials and workmanship, subject to the terms, conditions, and exclusions contained in the Defender Bikes Warranty & Liability Policy.

Third-party components supplied on Defender bicycles remain subject to the warranties offered by their respective manufacturers. The Warranty & Liability Policy is incorporated into and forms part of these Terms of Service.

11. Bicycle Safety and Intended Use

Cycling involves inherent risks, including the risk of property damage, falls, collisions, serious injury, and death.

Customers and riders are responsible for operating bicycles appropriately, maintaining them in safe working condition, performing reasonable inspections, using appropriate safety equipment, and riding within their abilities and the intended use of the bicycle.

Do not ride a bicycle that you believe may have a damaged or improperly functioning safety-critical component.

Nothing in these Terms eliminates any responsibility Defender Bikes has under applicable product safety or consumer protection laws.

12. Third-Party Products and Services

Our bicycles and website may incorporate, reference, or interact with products or services provided by third parties.

Defender Bikes does not control the independent policies, services, warranties, or websites of those third parties.

Third-party bicycle components remain subject to any applicable manufacturer’s warranty terms.

13. Intellectual Property

The Defender Bikes name, logos, bicycle designs, graphics, photographs, videos, written content, product names, website content, and other brand materials may be protected by trademark, copyright, design, patent, trade dress, or other intellectual property rights.

Unless otherwise stated, website content is owned by or licensed to Defender Bikes.

You may view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, sell, modify, commercially exploit, or create derivative works from protected Defender Bikes content without prior authorization.

14. Customer Content

If you voluntarily submit reviews, photographs, comments, testimonials, or other content to Defender Bikes, you represent that you have the right to provide that content.

You remain responsible for content you submit.

Defender Bikes will obtain any permissions reasonably required before using customer-submitted photographs, videos, testimonials, or other identifiable customer content for advertising or promotional purposes where such permission is required by applicable law.

15. Privacy

Our collection and use of personal information is described in the Defender Bikes Privacy Policy.

By using our website, you acknowledge that information may be processed as described in that policy and as otherwise permitted or required by applicable law.

16. Disclaimer of Warranties

Except for warranties expressly provided by Defender Bikes and warranties or rights that cannot legally be excluded, products and services are provided subject to the terms stated in the applicable Defender Bikes policies.

To the fullest extent permitted by law, Defender Bikes disclaims implied warranties to the extent they may lawfully be disclaimed.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Defender Bikes will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or Defender Bikes products.

Nothing in these Terms is intended to exclude or limit liability, warranties, remedies, or consumer rights that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Defender Bikes harmless from claims, losses, or expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

This provision does not require a customer to indemnify Defender Bikes for Defender Bikes’ own negligence, defective products, or other liability that cannot lawfully be transferred to the customer.

19. Changes to These Terms

Defender Bikes may update these Terms from time to time to reflect changes in our products, services, business practices, or legal requirements.

The current version will be posted on our website with an updated revision date.

Changes will apply prospectively and will not retroactively alter material terms of an already accepted purchase unless permitted by law or agreed with the customer.

20. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any rights available to consumers under applicable federal, state, or local law remain unaffected.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

22. Entire Agreement

These Terms, together with the policies incorporated by reference and any order-specific terms agreed between the customer and Defender Bikes, constitute the agreement governing the applicable website use or purchase.
